📋 Terms of Use

1. Acceptance of terms

By downloading, installing, or using the BabyTaps application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

If you are accessing the App on behalf of a minor, you (the parent or legal guardian) accept these Terms on their behalf and are responsible for their use of the App.

2. Description of the App

BabyTaps is a free sensory play application designed for infants and toddlers. It provides interactive visual animations, synthesized sounds, and haptic feedback in response to touch and device motion inputs. The App includes four visual themes (Confetti, Bubbles, Space, and Animals) and a parent-accessible settings panel.

3. Eligibility and intended use

BabyTaps is designed for use by infants and young children under the direct supervision of a parent or legal guardian. By using the App you confirm that:

• If the primary user is a child, a parent or guardian has reviewed and accepted these Terms.
• You will supervise any child's use of the App and ensure the device is handled safely.

The App is intended for personal, non-commercial use only.

4. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial purposes in accordance with these Terms.

This licence does not include:

• Copying, modifying, translating, or creating derivative works of the App or any part of it
• Reverse engineering, decompiling, or disassembling the App
• Renting, leasing, lending, selling, or redistributing the App
• Using the App for any commercial purpose without our prior written consent

5. Intellectual property

All intellectual property rights in the App — including but not limited to the source code, visual design, audio synthesis algorithms, particle system, written content, and trademarks — are owned by or licensed to BabyTaps. Nothing in these Terms transfers any intellectual property rights to you.

The emoji characters displayed in the Animals theme are provided by the operating system platform (iOS/Android) and are subject to their respective owners' terms.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. BabyTaps collects no personal data from any user. Please review the Privacy Policy for full details.

7. Device and parental responsibility

You are responsible for:

• The physical safety of any child using your device (e.g. safe handling, avoiding drops)
• Managing your device's screen time settings in accordance with recommended guidelines for your child's age
• Ensuring the device is charged and in a safe physical state before use

BabyTaps enables "screen-on" mode (wakelock) to keep the display active during use. This is intended for play sessions and may affect battery life. Remember to close the app when not in use.

8. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will function without interruption or error
• Any defects will be corrected
• The App is free of viruses or other harmful components
• The App will be compatible with all devices or operating system versions

9. Limitation of liability

To the fullest extent permitted by applicable law, BabyTaps and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or damage to a device, arising out of or related to your use of or inability to use the App.

In no event shall our total liability to you exceed the amount you paid for the App (which is zero, as the App is free).

10. Prohibited conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to circumvent the parent control mechanisms within the App
• Use the App in any manner that could damage, disable, or impair the App
• Remove any proprietary notices or labels on the App

11. Updates and changes to the App

We may release updates to the App from time to time. These updates may be required to continue using the App on certain platforms. We reserve the right to modify, suspend, or discontinue the App (or any feature thereof) at any time without notice.

12. Changes to these terms

We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated where reasonably practicable (e.g. via an in-app notice on the next update). Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

13. Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer is based, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
